Internal documents obtained by CBS News show that the Biden administration has established a broad restriction on asylum that it intends to use to boost the speedy deportation of immigrants who enter the country through Mexico after the Thursday deadline for the Title 42 pandemic-era emergency provision.
Less than 48 hours before the termination of Title 42, the regulation was published on Wednesday, and hundreds of American asylum officials received enforcement training on Tuesday. The regulation’s finalization and the instructions sent to the asylum officers who will be putting it into effect were first covered by CBS News on Tuesday.

The rule represents the government going back to the border policy of the Trump administration and is likely to be challenged in federal court. If migrants do not apply for refugee status in another nation, such as Mexico, while coming to the southern border, they are ineligible for U.S. protection.
Due to recent record-breaking migrant arrival rates, this trend has recently grown more pronounced. These arrivals have taxed the already overburdened asylum system, inundated border neighborhoods, and turned Biden into an electoral risk as he prepares for his 2024 candidacy.
In the early stages of the epidemic, the US Centers for Disease Control and Prevention issued a public health order to stop the spread of Covid-19. Due to the related part in US law, this order is also known as Title 42 and gave officials the right to immediately deport immigrants at US land borders.
When people were found under Title 42, they were either deported back to Mexico or their native nations. Since the policy’s inception, almost 2.8 million migrants have been turned away at the US-Mexico border, based on figures from US Customs and Border Protection.
Title 42’s pandemic public health constraints, which were put in place during the Trump administration and utilized by officials to stop migrants from crossing the border into the US from Mexico, are set to expire on May 11.
Biden now goes back against his word in the 2020 debates where he said, “This is the first president in the history of the United States of America that anybody seeking asylum has to do it in another country. That’s never happened before in America.”
A few months ago, Chris Magnus gave notice of his resignation as commissioner of US Customs and Border Protection. According to reports, he was forced out and tried to take the credit for many of the mistakes made at the southern border by Alejandro Mayorkas, the secretary of the Department of Homeland Security.
“The President has accepted the resignation of Christopher Magnus, the Commissioner of U.S. Customs and Border Protection. President Biden appreciates Commissioner Magnus’ nearly forty years of service and the contributions he made to police reform during his tenure as police chief in three U.S. cities. The President thanks Mr. Magnus for his service at CBP and wishes him well,” a statement by Biden’s White House read.
After joining a group that advocates for police reform, Magnus has posted a number of not-so-subtle jabs about the ongoing immigration problem online and lost no time criticizing the Biden administration.
He recently wrote, “Susan Rice, Kristjen Nielsen,” in reference to an article regarding the forced labor of immigrant children and how the Biden administration “ignored warnings.”
“Over the past two years, more than 250,000 migrant children have come alone to the United States. Thousands of children have ended up in punishing jobs across the country — working overnight in slaughterhouses, replacing roofs, operating machinery in factories — all in violation of child labor laws, a recent Times investigation showed. After the article’s publication in February, the White House announced policy changes and a crackdown on companies that hire children,” the article stated,” according to the report.
In March, he tweeted about the border crisis in a similar way.
“Sadly-right on point,” Magnus tweeted in response to a Los Angeles Times article that described how President Biden’s administration is putting forth a new plan that is similar to one implemented by the Trump administration. The article’s main argument was that people who cross the border without authorization should not be able to easily apply for asylum in the United States.

Magnus shared a New York Times article from February titled “Alone and Exploited, Migrant Children Work Brutal Jobs Across the U.S.,” which described the “record numbers” of immigrants who entered the country under the Biden administration and how many of them were employed in “dangerous jobs that violate child labor laws.”
The NYT piece describes a traumatic experience for many immigrants once they arrive in the nation, despite the fact that it generally downplays the historic rise in immigration that the Biden administration has brought about.
What’s described in this article is sickening. Just sickening.

“These workers are part of a new economy of exploitation: Migrant children, who have been coming into the United States without their parents in record numbers, are ending up in some of the most punishing jobs in the country, a New York Times investigation found. This shadow work force extends across industries in every state, flouting child labor laws that have been in place for nearly a century. Twelve-year-old roofers in Florida and Tennessee. Underage slaughterhouse workers in Delaware, Mississippi and North Carolina. Children sawing planks of wood on overnight shifts in South Dakota,” the article stated,” according to the story.
The Times did add that 2021, Biden’s first year in office, saw the start of this new epidemic.
The story also briefly mentions how since Biden assumed office, illegal aliens trying to enter the country have wreaked havoc on the U.S.-Mexico border.
