Former U.S. Attorney General Bill Barr panned former President Donald Trump, claiming he’ll likely be charged for obstruction of justice in the classified documents case.
Barr first criticized the Manhattan Democrat District Attorney Alvin Bragg’s case against Trump on Sunday, calling it an abuse of prosecutorial power.
“I don’t think it has any merit. I think it is transparently an abuse of prosecutorial power to accomplish a political end,” Barr said on ABC’s “This Week.”

But Barr then claimed that special counsel Jack Smith’s investigation into Trump’s possession of classified documents at Mar-a-Lago is a more serious matter.
“I’d be most concerned about the documents at Mar-a-Lago,” Bill Barr said. “I think that’s a serious potential case…He had no claim to those documents. I think they probably have some very good evidence.”
“I think he was jerking the government around and they subpoenaed it, and they tried to jawbone him into delivering the documents. But the government is investigating the extent to which games were played and there was obstruction and keeping the documents from them,” he added.
Smith recently obtained “new and significant evidence” of potential obstruction after the DOJ subpoenaed the classified documents in May 2022, according to DOJ leaks obtained by the Washington Post.
Namely, the leak claims emails from former Trump aide Molly Michael allege Trump rummaged through boxes of classified documents after he was subpoenaed in May.
Trump’s spokesman Steven Cheung responded to WaPo’s reporting, claiming “deranged” special counsel Smith illegally leaked info to interfere in the 2024 election.
“The witch-hunts against President Trump have no basis in facts or law,” Trump spokesman Steven Cheung said in a statement to WaPo. “The deranged special counsel and the DOJ have now resorted to prosecutorial misconduct by illegally leaking information to corrupt the legal process and weaponize the justice system in order to manipulate public opinion and conduct election interference, because they are clearly losing all across the board.”
Notably, former special counsel Robert Mueller used similar law-fare tactics against Trump in 2019.
After a two-year investigation finding no underlying crime, i.e. evidence Trump “colluded” with Russia to win the 2016 election, reports emerged that Mueller was considering charging Trump with obstruction of justice instead.
But how does one obstruct justice when there is no underlying crime?
Like Smith’s investigation, Trump did not appear to have committed an actual crime, as he was within his rights as president to possess the documents, and was already working with the National Archives and Records Administration (NARA) and the FBI to turn over classified documents he had stored at his Mar-a-Lago resort.
The FBI also visited Mar-a-Lago in June 2022 to request more of the documents, which Trump turned over.
Nevertheless, the FBI raided and searched the compound in Aug. 2022 to seize more classified materials.
